AN ESSEX PUBLICAN SENT TO PRISON

 
       At the Chelmsford County Division Petty Sessions on Friday, the following case of stealing and receiving stolen goods was heard :-
     Archer Lodge, stockman, of Roxwell, was summoned for stealing two bushels of black oats and half-a-bushel of white oats, valued at 7s., the property of his master, Mr. A. B. Barrow, on May 10th.  Thomas Edward Turney, landlord of the Fox and Goose Inn, Writtle, was summoned for receiving the oats, knowing them to have been stolen.
     Mr. Wm. Tanner was for the prosecution, and Mr. W. J. Gray defended Turney.
     Mr. Tanner said Mr. Barrow hired a piece of land from Turney to feed some lambs upon, and it was Lodge's duty to take corn to the sheep.  In consequence of certain information received, Lodge was suspected of not giving the sheep all the oats he was supposed to.  As a result of investigations, oats corresponding with those belonging to the prosecutor were found in Turney's stable.  In answer to P.c. Scott, who spoke to him about the matter, Lodge said, " Yes, I have left about four or five lots at Turney's.  I wish to God I had let them alone.  I have left about two and a-half bushels at Turney's, but I have had nothing from Turney except beer and tobacco - no money.  I should not have left them only Turney asked me to.  He said he would give me some beer for them."  When Turney was seen about the matter he contended that he could account for the possession of the oats, but afterwards said he could not resist pleading guilty to having received them.
     P.c. Scott bore out the statement of Mr. Tanner, and added that Turney asked him how he thought he would get on.  Witness replied that he did not know, and defendant proceeded, "I shall plead guilty ; I can't get out of it."
     Wm. Tidey, a groom employed by the prosecutor, and Harry Gurton, a groom in the service of Abridge Brewery, also gave evidence.
     Both defendants pleaded guilty, and Mr. Gray addressed the bench on Turney's behalf, drawing attention to the good character he had hitherto borne.  He read a letter from the Rev. H. M. Burgess testifying to this, and said the defendant only wished to dissent from the statement of Lodge that he asked for the oats to be left at his place.  Mr. Gray reminded the Bench that as the defendant had pleaded guilty, he must of necessity forfeit his licence, and he would be debarred by the Statute from ever holding another.  He had a wife and seven children dependant upon him, and would leave the court practically a ruined man.
     The Bench having .............. the Chairman said the Bench felt that if there were no receivers there would not be half as many thieves, so that when they caught a receiver they meant to make an example of them.  Lodge, being a servant, ought to have protected the property of the man he robbed.  He would be fined £2, and in default of payment be imprisoned for one month.  With regard to Turney, the Bench felt it only just that he should not be given the option of a fine, and so he would be sentenced to a month's hard labour.  They thought there was no doubt that he led Lodge on to steal his master's oats. - Time in which to pay was refused Lodge.
